Welcome to ArtOnSet. These Terms of Use govern your access to and use of the ArtOnSet mobile application and related services. By downloading, installing, or using ArtOnSet, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using ArtOnSet, you confirm that you have read, understood, and agree to these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

2. Description of Service

ArtOnSet is a mobile application that allows users to visualize artwork, ceramics, and other objects in real-world environments using custom photo backgrounds. The app enables you to:

  • Stage artwork and objects using your own photos as backgrounds
  • Upload and manage images for visualization
  • Adjust lighting, shadows, and scaling for realistic staging
  • Capture and share screenshots of staged artwork
  • Access premium features through subscription plans

3. Eligibility

You must be at least 13 years old to use ArtOnSet. By using the app, you represent that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent to use the service.

4. Account Registration

To access certain features, you must create an account using Sign in with Apple. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions and Payments

### 5.1 Subscription Plans

ArtOnSet offers subscription plans that provide access to premium features. Subscription details, including pricing and features, are displayed in the app before purchase.

### 5.2 Billing

Subscriptions are billed through Apple's App Store. By subscribing, you authorize recurring charges to your Apple ID account. Prices may vary by region and are subject to change.

### 5.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Apple ID settings.

### 5.4 Refunds

Refund requests are handled by Apple according to their refund policies. We do not process refunds directly.

### 5.5 Free Trials

If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial ends.

6. User Content

### 6.1 Your Content

You retain ownership of images and content you upload to ArtOnSet. By uploading content, you grant us a limited license to process, display, and store your content solely for providing the service.

### 6.2 Content Restrictions

You agree not to upload content that:

  • Infringes on intellectual property rights of others
  • Contains illegal, harmful, or offensive material
  • Violates any applicable laws or regulations
  • Contains malware or malicious code

### 6.3 Content Removal

We reserve the right to remove any content that violates these terms without prior notice.

7. Intellectual Property

### 7.1 Our Property

ArtOnSet, including its design, features, code, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the app.

### 7.2 Feedback

Any feedback, suggestions, or ideas you provide about ArtOnSet may be used by us without obligation or compensation to you.

8. Prohibited Uses

You agree not to:

  • Use the app for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Use automated systems to access the app without permission
  • Resell or commercially exploit the service without authorization
  • Misrepresent your identity or affiliation

9. Third-Party Services

ArtOnSet may integrate with third-party services, including Apple services. Your use of such services is subject to their respective terms and policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

ARTONSET IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. STAGED VISUALIZATIONS ARE APPROXIMATIONS AND MAY NOT PERFECTLY REPRESENT ACTUAL ARTWORK DIMENSIONS OR APPEARANCE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF ARTONSET. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of ArtOnSet, your content, or your violation of these terms.

13. Termination

We may suspend or terminate your access to ArtOnSet at any time, with or without cause, and with or without notice. Upon termination, your right to use the service ceases immediately.

14. Changes to Terms

We may update these Terms of Use from time to time. We will notify you of material changes through the app or by other means. Your continued use of ArtOnSet after changes take effect constitutes acceptance of the updated terms.

15. Governing Law

These terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these terms or your use of ArtOnSet shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits.

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and ArtOnSet regarding the service.
